Pre-poll image build up an old fashioned exercise seems to be in action for justice to the minorities and downtrodden conspiringly by Congress, central agencies and common agents i.e. of Congress and BJP e.g. SGPC Chief Avtar Singh Makkar as a show of sincerity to remove self created irritants likely to be done away with black list of Sikhs, to have distance from leaders Sajjan Kumar, Jagdish Tytler etc, accused for the genocide of Sikhs just to keep away the regional parties tarnishing their picture by corrupt practices from the Lok Sabha in the coming elections of parliament of India.

At the same time, Congress and BJP have hands in glove in order to further project the agenda of Hindutva in the elections to out smart each other for the appeasement of Hindus, the majority community.

The services of projected hard liners as usual, may be in any form anywhere, would be utilized for enhancing the vote bank of the parties differentiated as hard and soft Hindutvas i.e. BJP and Congress.

‘Let us fight for clean and green environment’

LUDHIANA-City master plan
Ludhiana city clean and green must be motto for human peaceful and comfortable living forever as per Article 21 of the Indian Constitution

Submission to declare non-industrial to the densely populated residential areas including Vishvakarma Colony etc for healthy, peaceful & calmness, un-harmful, safe and free from all types of pollution for worth human living constitutionally and also to keep Ludhiana clean forever in the ‘City Master Plan’ that would be implemented shortly.

REPRESENTATION TO ALL RESPECTED FOR obliging and pursuing the case for JUSTICE and forward TO ALL THe AUTHORITIES CONCERNED for meaningful consideration in view of the submission.

Political hue and cry is only to give impression that the thickly populated and residential areas are free and safe now from environmental pollution i.e. noise, air and water pollution whereas it is not so in the ‘City Master Plan’ as per information received, the most populated area e.g. Vishvakarma Colony, Partap Nagar and its surrounding areas are declared mixed or Industrial area for the disadvantage of the residents and to the advantage of a few traders, industrialists for the reasons best known to the politicians and officials concerned.

It is predominantly residential area where houses are meant for residential purpose only as per sale deeds of the residential houses built in the area in small plots ranging from 50 sq. yards to 200 sq. yards.

The voter lists of residents, ration cards issued, small size of houses-be verified from respective sales deeds, plots meant for residential purpose only, size of streets, situated number of Temples, Gurdwaras, schools for the children of poor residents of the area are always remained self explanatory for the surveyors took part to prepare the plan.

The ‘City Master Plan’ so declared ignoring the areas, Vishvakarma Colony etc without giving it the status of residential area only shall encourage grave pollution i.e. air, noise & water and take away the fundamental right i.e. Right to life, healthy peaceful living, pollution free environment, calmness, and studies of children in the area.

It is our humble submission before the authorities concerned through the reputed newspapers and respected others for relief and justice by declaring the areas residential only and free from environmental pollution i.e. noise, air and water pollution in the ‘City Master Plan’ to make the area and Ludhiana city clean for human peaceful and comfortable living forever as per Article 21 of the Indian Constitution.

Please do oblige, pursue and forward the case for meaningful consideration in view of the submission-Thanks

COMMENTS

There are precedents that the minority and even with very too little mandate governments did perform constitutional functions in India.

There is nothing wrong to say in that context by US that "As long as it is duly-constituted government of the country, we can sign a deal with it," in view of earlier sent comments by me and published on 26 January 2008 that to demand to have approval of parliament always of treaty, accord, agreement, settlement, pact, Contract etc amounts to like sending a message that there is no government in India worth functioning validly and legally.

As to why the Supreme Court is being asked by the so-called nationalists to get the approval of the beneficial N-deal? There is always gain and surrender of some rights in every deal as rightly observed in this case by the Supreme Court of India. The SC did not interfere in the act of State terrorism so far which remained the national policy and strategy. The Supreme Court has same yardstick for inhuman and for the human acts. The constitution of India is silent or allows doing discrimination.

As Article 14 stands logically explained that the Indian Constitution does not envisage a willing and graceful conferment of equal status on all Indian citizens without putting them into the necessity of incurring large expenditure on organisation and litigation. The onus of claiming equality is placed on shoulders of the people who can take the trouble and afford of going through the ordeal.

What about the menace of terrorism?

Does the Militancy always suit politically and strategically under the specific national policy though secret to any central government of India?

Is it difficult or not in the national interest to disclose the links with the politicians and secret agencies of the militants surviving and free and having no ideology except kept and protected to create terror among common people by routinely false and self managed external threats and at the same time also boasting that terrorism is completely wiped out and no chances ever of revival of the evil?

Is the threat of militancy always maintained to harm and teach a lesson by different cruel means directly and indirectly to the families/person(s) possess their independent thinking and views like me? How long it all has to be kept closed door secret in the modern age, that so called militants always do maintain links with the politicians and secret agencies when there is no communication gap in face of latest monitoring information technology?

I am of the view that the agencies that matter must stop and be forbidden from playing their destructive role to crush the families/person(s) possessing independent thinking and views and the state machinery should always be ready and willing for open dialogue to redress their genuine grievances and the constructive demands instead of applying, adopting and encouraging very destructive approach through their puppets etc like so called militants.www.sikhvicharmanch.com

The money collected by way of bribe being used for the reception of VVIP’S and also as a source of their earnings illegally.

Any action or statement to check the corruption is purely eyewash and misleading exercise, may be anytime to fix selected officials revengefully.

It is a matter of open knowledge that recently Punjab government thought to raise special Deputy Commissioner’s fund for the reception of VVIP’S and planning not to collect money through Revenue Officials by way of corruption after the special Deputy Commissioner’s fund approved finally and legally for the purpose. Whether the same is approved or not, is not yet announced.

The practice of corruption is open and in the knowledge of the agencies who alleged to be deputed to check the corruption in the revenue department and elsewhere. The every active, earning post and the seat is on sale in the government departments matter.

Is the publicity of checking corruption not a spider net to catch the honest and finish him and at the same time to keep it further going on at the large scale as a great earning source for high ranking politicians and their associates, officers through their brokers and petty revenue officials? Central Budget 2008-09 and Aam aadmi i.e. common man

Central Budget 2008-09: Whoever says that there is nothing in the budget for Aam aadmi i.e. common man and termed the Union Budget as lacklustre must also understand and first try to get himself educated that the Indian Constitution itself is not meant for the welfare of Aam aadmi i.e. common man but the Aam aadmi i.e. common man could always be penalized to keep him unprivileged and mum in every field under the constitution i.e. the spirit of the constitution and that is the only suitable and proper reply in brief to the critics of the budget from the opposition and others who do also appreciate the budget by other way identifying it as election manifesto though they (politicians in opposition) are very much aware and have knowledge that for the reason, India is not yet prosperously known and fully managed country so far among the respected welfare States of the World. www.sikhvicharmanch.com

'N-deal must come to US by May or it fails'

For congress party includes UPA, the implementation of the nuclear agreement could prove a landmark achievement and the main election issue in its favor on the grounds of beneficial aspects of N-deal and being one of the biggest contribution for India in the field of energy and peace otherwise BJP includes NDA after coming into power is also ready and willing on the line for accepting even very hard terms and conditions of US provided the deal renegotiated.

It is better for the present government to create history by implementing the nuclear agreement and face the coming Lok Sabha elections on the issue boldly without bothering the outcome of the results of elections.

Indians voters having almost same negative image and impression for all politicians, they may be in any party but that attitude of voters would likely to change with such a remarkable achievement.

The present trend of down fall of congress in the country is likely to be reversed in case UPA succeeds to create public opinion in its favour on the issue after acceptance of implementation of the nuclear agreement and the benefits of N-deal.

Dr. Manmohan Singh, Prime Minister of India does possess courage to do it with having the whole hearted support of Sonia ji.

Let it be communal clash supported by government machinery directly and indirectly, Kidney, sex racket or any other scandals and crime always high profile politicians, officials etc are reported involved for giving clear cut message that nothing is going to happen and the accused would escape untouched without facing justice. Ultimately, same thing happens. Is the high pitch and very loudly exposed news remains for the purpose of frightening the aggrieved and common people or for the consolation only? Who is more benefited, the aggrieved or high profile politicians, officials etc involved in the crime so far? Then, what is the alternative left to get justice in India? Now, it can also be said this way that GANDHI’S great granddaughter Neelam Parikh last week immersed his ashes into the Arabian Sea. Neelam Parikh has done the right thing as his followers to do open style violence and crime have taken over Parliament and politics for fully highlighting his name in the World. Would the net result be disintegration anytime of India and bloodshed everywhere?

The statement is a clear cut confession though differently and by shifting the blame that the Indian system is being run by criminals or running at their instance presently.

Is Dr. Manmohan Singh a mask?

To see the Criminality in action and the System! Whoever blaming Dr. Manmohan Singh, Prime Minister of India for the spoiled present set up, is trying to say and the inference could be drawn safely and correctly that Dr. Manmohan Singh is a mask i.e. false face in the prevailing Indian criminal system like BJP leader Vajpayee ji, communist leader Som Nath Chatterjee ji etc.

But rest all behind is totally a criminal network operating in the name of democracy and secularism to project the falsehood of unity and integrity of India.

Isn’t the system worst modern but hidden dictatorship defeating all internationally accepted presently norms and values of the World?

Politically divided security men, administration and workers are always likely to disturb security prospects under criminal set up in India. Law and Order situation worst-Reasons:

What is difference between the constitutional terrorism (have backing) and the act of individual terrorism or crime may be petty in India?

To understand the difference, you have to be weak, poor having no backing to claim equality including like serving Military, ex-soldiers of any rank as experienced. How many people in the poorest India have the courage, the resources and enough popular backing to claim equality before law, then alone the state shall not deny it and if there is no claim, the question of denial does not arise (emphasis added) in the constitution of India?

The wording of Article 14 of the Indian Constitution does not envisage a willing and graceful conferment of equal status on all Indian citizens without putting them into the necessity of incurring large expenditure on organisation and litigation.

Article 14 as drafted denies any person equality before the law or the equal protection of the laws within the territory of India or any child born to Indian parents should automatically have equality of status conferred on him or her by the constitution.

It means the constitution itself permits constitutional terrorism against the weak, poor having no backing to claim equality including serving Military personnel, ex-soldiers of any rank and the similar downtrodden categories of Indian society. Is there any remedy to it for justice for the hapless in India?

Is the local Police Control Room (PCR) fleet only for news purpose or in reality to prove a confidence build up exercise for people?

What is the conduct, dealings and past history of our own police, rulers i.e. politicians after independence of India?

Can police of India justify the system and prevailing situation of injustice in India? Who is inciting them to do all?

To my mind, media unjustifiably suppressed the information from the people due to fear of police excesses and for other considerations and the situation is not much changed.

Who are responsible for all and the injustice is being continued in every field here in India?

The police and Indian agencies know better than us.

Are the police and Indian agencies not meant to help and shield the corrupt, influential and rich for reasons of “extortion” from the common people in India?

The way system in action in coordination with each other, is it easy to identify the promoters of criminals in India*?

The Vigilance Bureau proposes the prosecution legal team disposes. Why? Really, no body knows about it. What a strange story of judicial system? As reports coming in, the Vigilance Bureau proposes the prosecution legal team led by District Attorney Mitr Sain Goel (As per my information received, he is frankly confessing it*) disposes to favour the accused in the case.

The way, former Chief Minister of Punjab, Captain Amarinder Singh got reception from the lawyers matter and the silence of the prosecution legal team to favour the accused might be another case of investigation for Vigilance Bureau hereafter in case there is no mutual understanding between the parties.

The prosecution legal team did not argue the case at the preliminary stage itself against the accused on the alleged line arguments were prepared and decided to advance and stress forcibly what to talk of leading the evidence as per prosecution story in this case hereafter.

It shows that deputed mediators for award must have worked hard in advance to the satisfaction of the accused i.e. more than the Vigilance Bureau and prosecution team with or without the knowledge of the investigation team and the government of Punjab.

Is it not a fit case to investigate and for action as to how the politicians, influential and rich are helped and remain out of the purview of judicial system in India?

The common people do have sufficient reason and cause to be frustrated and pessimistic from the outcome in the system with reference to such cases.

Where is the fault?

Every body is expressing his feeling that all this exercise finally to prove futile in the eye of law as usual by supporting with the history and fate of such cases in the past despite all pain and time consuming costly but in record time bound alleged to be flawless investigation and the prosecution story against the accused.

Is there any cause of serious apprehension in the minds of common people that law is inoperative in India against the politicians, influential and rich?

I myself being a lawyer here in the field do agree and always experience the cause of injustice and absence of Rule of Law.

Is there any honest who can come forward to say more or anything positively regarding the system?

I am optimistic that days are not far away when the justice shall prevail to the satisfaction of all including poor and the system is definitely likely to change and a new picture has to emerge for justice to all.

The police team alleged to have been beaten or earlier police remained posted here could be partner directly or indirectly any time of the poppy husk smuggler.

The smuggler might be paying low rate monthly presently to police for sheltering as well as bringing him in the business in the past as is normally happening in the country otherwise without backing it is very rare to commit any offence or to do such a business so daringly by any individual.

As to how and what for the smuggler dared to do so or behaved rudely with the police? The poppy husk smuggler must have very old association with the police in the business.

To my mind, the truth is not likely to come out of the World of criminals as the partners have their own code of conduct to follow to continue and remain in the business forever even hereafter.

It is all nothing but a part of State terrorism always to terrorize law abiding citizens in India.

I never had any desire to purchase any car keeping in view the price of cars in the market and competition due to incapability and incapacity of my own buying power, to afford maintenance beside traffic problems, sparing a space at home for it.

For the reasons, I never desired to have any so far, remained comfortable and never felt myself poor till date.

Now, I desire to have TATA nano or deluxe (ac) and start feeling myself poor.

It may be happy news for all and again not for poor.

Anyway, I wish good luck for the adventure and a step forward in the technology.

The system of State terrorism may cause global terrorism

In view of serious allegations and apprehensions of conspiracies of elimination to Uttar Pradesh Chief Minister Mayawati, Punjab Chief Minister Parkash Singh Badal and former Chief Ministers and the other leaders and the demand of security same as of Prime Minister even if law is required to be amended for the purpose, under the garb of terrorism are real or such news are get planted, intentionally and deliberately, to project the unsafe and unsecured atmosphere prevailing in India or it is just a notice to terrorize the masses to rule over them without taking responsibility of their safety and security in any manner?

Under the circumstances, what is the fate of citizens of India regarding their safety and security? Is it possible to imagine and answer it globally?

It is not out of context to mention that the States and the Supreme Court do not have faith in the investigation of CBI and for the reason, the government of Punjab to oppose transfer of Virk case to CBI by quoting, “the case of Sohrabuddin Sheikh versus the state of Gujarat. A Division Bench of the Supreme Court in May last had ruled that there was no reason to hand over the case to the CBI and asked an IG-level officer Geeta Johri to investigate it” as reported.

Is the terrorism creation of the States and Central Agencies in India to terrorize the leaders and the masses to terrorize them including Whistle-Blowers? Are the acts of terrorism planned to defame the State governments at the instance of government of India through their agents and the agencies in connivance with the cats, criminals, and puppets?

For example, the way Shingaar blasts at Ludhiana stories are being reported and the investigation is going on is really reminding the strange affairs of the past State terrorism in Punjab practiced and exercised under the National Policy and Strategy.

In nutshell, the State terrorism is a toy to earn by way of “extortion” by different means and the terrorism is within the reach of the agencies. And the stories are propagated systematically by the State and Central Agencies in India with the help of puppets that the so and so involved, arrested, tortured more are likely to be arrested and some are released after unbearable torture and keeping in custody unofficially and again wanted and are likely to be arrested soon etc in the crime?

The further extension of the system of State terrorism may cause global terrorism in a big way to disturb peace permanently and then no system of justice is likely to be effective thereafter.

It is proper to submit that it is time to act not only to watch internationally for all.

To my knowledge and experience till date, the police can bring revolutionary change in law and order situation provided it is honest.

But mostly the police by different illegal means and on the pretext of inquiry, intentionally puts the person(s) according to its choice in fear of injury to the persons, or to any other, and thereby dishonestly induces the persons so put in fear to deliver to any persons any property or valuable security or anything signed or sealed which may be converted into a valuable security, commits always “extortion” and the police itself is a great source of criminals breeding in India especially in Punjab.

The menace is in open knowledge of administrators and the politicians who come up to the stage of honour through the process of touting, informers etc.

Whoever did embezzle the huge property in the process is criminal and the Indian police are bossing all of them and always behave like head of criminals in India.

Recently, during discussion and off the record arguments, I narrated the real story before a Deputy Commissioner that when I was a law student, then it was rightly said during an organized debate that the actual knowledge of law only could be learned by self involvement in a process facing the police atrocity in police stations.

But how and who can afford the process to get ruined his career? In reply to the question was that nothing more than this can be said or advised.

The reference was obvious that the breeding of criminals starts from the Indian police stations and police is no way only a law and order maintaining agency in India.

The perception is not changed in any manner so far.

Militants nabbed for Shingaar blast-The contradictory versions of prosecution stories as being reported in the press time to time since the occurrence of the heinous crime is not only legally convincing and could not be believed finally in the eye of law but it is also not appealing to any prudent mind.

However, no one like me has any locus standi or allowed to interfere and the investigating agencies are free and expert to give shape and manipulate the prosecution story in arbitrarily manner and the poorer and uninfluenced are always fixed at will to cover up and complete the investigation of pending cases by hook and crook under the system.

Whatever is being commented by me is nothing new in the context of this particular case as it is general practice in India to the knowledge of all investigating agencies seriously concerned and Indian courts are also not in dark and exception to it.

To cry for justice at all level is right of everyone and now I as a common man pray for justice in general for all before CM Badal sahib and his family members who are more familiar and experienced with the practice and system especially when CM Badal sahib himself is controlling Punjab and supervising the system.

I am optimistic to get justice and hope for change in the prevailing system when the whole World is watching to see and expect India to become a true welfare democratic mature State of the World.

Former Director CBI Joginder Singh including other prominent and very responsible personalities on various TV channels undoubtedly and openly stated that the investigating agency CBI, commissions and other agencies concerned exceptionally and very badly handled the investigation of Sikhs genocide November 1984 in Delhi and elsewhere in the country till date and miserably failed to bring the culprits to face justice.

It is nothing but total failure of system and any political party and hired criminals could do the same any time in the country.

In view of the report before the court on September 29, 2007 by CBI claiming that one Jasbir Singh had allegedly heard Tytler inciting a mob to kill Sikhs after the assassination of former Prime Minister Indira Gandhi but his whereabouts could not be located” what else would be expected from the investigating agencies for justice in India.

Former Union Minister Jagdish Tytler is repeating the only defence in his case and for the other killers that when there was curfew all over in Delhi as how the killings took place and there is no reason of being present of Jasbir Singh on the scene to see and hearing him (Jagdish Tytler) inciting a mob to kill Sikhs after the assassination of former Prime Minister Indira Gandhi.

Is he trying to say that the genocide of about 3000 Sikhs alone in Delhi during that period a false, fabricated and baseless story?

Did he condemn the killings during those days? Or did he remain busy to supervise the killings and inciting the mob with the help of Delhi police under special instructions to do and finish the task on time?

There is tons of evidence out there. If the govt can really provide immunity to their own forces, this can be wrapped up real quick.

What I mean is, if Govt can come with a plan to forgive all those who come forward with the evidence or as evidence, may it be murderers or witnesses, we can get to the bottom of it real quick. Although insiders have confirmed that Govt exactly knows how it happened, but is afraid to pin point the charge.

Sajjan and Tytler and others are just small actors and this saffron "Tilak" on their forehead is protecting them. Do you know what I mean?

We are interested in letting people know the truth, and prevention of this nonsense behavior, again if that can be stooped. Chances are less, because this animal instinct is getting more and more powerful in "Kalyuga"

The other alternative is to "stay the course" and do your home work: never get deviated from path of kindness and compassion. And Let them go to hell.

IN RE: 'CBI leaks' on Nandi firing: CPI (M) may take it up with Centre

The politics of pressure tactics for manipulation of press by the politicians is hidden motive in taking up the issue of "leakage" of the CBI report with the Centre.

During the turmoil in Punjab and till date, the stories on basis of cases registered by the police and reported by the other agencies against Sikhs are being published, intentionally and deliberately, with the idea to defame the whole community as terrorists.

To put into practice is normal and nobody objected the stories published so based on registered cases or otherwise reported by the investigating agencies only.

After the registration of case, the prosecution story is deemed to be a public document and anyone can obtain its certified or uncertified copy or otherwise as it is the practice unless specifically it is barred under the law.

In no way, the publication of story is ever considered defamation or "case of selective leakage" and "the matter is also not sub-judice” for the purpose in the eye of law.

Now West Bengal Chief Minister Buddhadeb Bhattacharjee is likely to take up the leakage of case with the Centre of the CBI report into the March 14, 2007 Nandigram violence and in connection with the case of CPM leaders raped mother and daughters in Nandigram.

It seems to be only a political stunt and pressurizing tactics otherwise nothing unusual happened against the prevailing practice in India.

National Human Rights Commission (NHRC) deserves appreciation for taking serious notice with the remarks, "Nandigram and Godhra were severe assault on the face of the democracy. They were the worst scars on the face of nations. It is shameless to see that human rights were violated in such a way."

The meaningful assurance is given for adequate action and commitment to protect the rights of the people, who were victims of "opportunist" politics in both the states.

The bureaucracy, police in general and the ruling party never accepted judicial verdicts as correct or respected whenever question their unlawful authority or arbitrary discretion being unconstitutional in India.

Like the judiciary, NHRC does not act in such cases independently and impartially except to prefer mum due to the allergic attitude of those who matter to implement or act upon according to the verdicts, findings and for the reasons of other considerations.

Such remarks are taken only as verbal consolation like similar judgments ignored silently and remained on papers without any implementation or judiciary refused to act at all in order to provide justice to helpless aggrieved.

It is wrong to single out any particular party on this account but here only difference is that the CPM dubbed the Calcutta High Court order declaring the March 14 police firing in Nandigram ‘wholly unconstitutional’, as ‘interference in the state and Centre's jurisdiction’ openly without maintaining silence against the practice in India.

We can find number of similar judgments ignored silently and remained on papers without any implementation or judiciary refused to act at all in order to provide justice to helpless aggrieved.

For the reasons, it is rightly being said that the judges are working under the very tight position and unable to hear or entertain such cases for justice except verbal consolation.

Let us view the N-deal in the present context when US is in the capacity to provide umbrella from the external threat and question of aggression does not arise in the given circumstances.

But on the other, India and Pakistan like countries might be in position with their know-how and capability for mass destruction only in the suicidal capacity.

For such countries, US do possess sanction/force to rightly use and direct convincingly to avoid it and follow the right path in the larger interest and for welfare of humanity. Here stress is given more on sanction/force knowingly to attach importance to US presently as a legal entity to enforce and proceed with the N-deal.

Whenever, India shall be possessing such or better capability to do and think about the welfare of humanity, she would be free to revoke any deal and automatically come herself into that position.

Pakistan lawyers show extra-ordinary courage in the given circumstances-Congratulations

The Advocates along with judiciary as a class is always remained in the forefront to raise voice fight against and face the atrocities committed by the State in any freedom struggle in the World. Pakistan Judges and lawyers did show extra-ordinary and appreciable courage in the given circumstances.

The Administration of Justice in India
No-doubt- Pravin Mahajan did kill his brother

No-doubt, Pravin Mahajan did kill his brother, Bharatiya Janata Party leader Pramod Mahajan but the trial court has to take all the evidence and circumstances into consideration as what are the reasons that Pravin Mahajan had gone to that extent?

Whether Pravin Mahajan (accused) was insane at the moment? Whether the murder is the result of any sudden provocation? To what extent the Bharatiya Janata Party leader Pramod Mahajan contributed in his very sad story of murder and that would be remembered as a stigma in Indian society?

Whether both the prosecution story as well as defense version are concocted in the case and to what extent these could be relied upon? Whether the witnesses are planted and the circumstances are being manipulated by the prosecution and accused after thought in the case?

To see, whether the emotional feelings of accused and contribution of Pramod Mahajan in his own murder are sufficient to kill someone at Will leaving aside the defence of sudden provocation? Though, it may help the accused to mitigate the quantum of punishment to him in this case.

All the omissions and commissions committed in the case are material on the part of prosecution and defence for consideration and those could come out only from the contradictions in the statements of witnesses before the trial court to reach a conclusion to that effect and for just decision.

The purpose of Cross-examination of the witnesses is to test their veracity and that only compels the trial court to allow counsel for liberal and lengthy Cross-examination under law in the case though Re-examination (The examination of a witness, subsequent to the cross-examination by the party who called him, shall be called his re-examination) rarely granted to fulfill the lacuna left by the witness.

It is all legal process to avoid that the Judges should not act in arbitrary manner merely keeping in mind the prosecution story which remains mostly concocted and full of plantations due to undue political pressure and influence, inefficiency of investigating agency and bribe in India.

The in-camera proceedings are being fixed seldom in the larger interest of society for keeping law and order maintained.

But here in India such proceedings are always not fair for the reasons of fear and chances that while recording the statements of witnesses, there might be some kind of manipulation of circumstances etc in support to the prosecution story or to help the particular accused for the political and other reasons and compulsions to bring desired results.

For the reasons stated above, I did not opt to practice as a criminal lawyer and whenever tried to do the same, State put her all efforts to keep me away as personally experienced by me in number of cases.

The ‘Conference on Federalism’ to be held from 5 to 7 November, 2007 under the Chairmanship of Dr. Manmohan Singh, the Prime Minister of India that is to be and has to be limited for the States of united India, unitary in reality, but wrongly projected federal (being propagated based on Godly agreements and understandings) in character, now to be discussed/given/decided for their independent status i.e. ‘Economic Autonomous Status’ in practice in the conference at this stage, always to remain subject to negotiation and change any time in any manner.

As already pleaded and suggested by the forum of ‘Sikh Vichar Manch’ the way to solution of problems of ‘separate independent States’ without any external interference, may be in ‘Confederation of Consented Countries’ (COCC) subject to international norms and values for keeping cordial relations with all.

I being a lawyer practiced the concept from grass root level i.e. our home level onward and also in my legal profession to solve and settle the disputes of parties successfully.

Today, it is being said that “Mr. Mahatma Gandhi did also practice it in bringing about private compromise of hundreds of cases” though he left the masses to suffer for the untold irreparable loss and damages not likely to be compensated as experienced in independent India till date and there is no solution in sight so far of the endless miseries caused and continuing to people of India in the name of maintaining ‘Unity and Integrity of India’.

I do grasp and also experienced grass root realities and facts and then write otherwise I am not writer by profession nor it is my source of livelihood. For example, I am no way criminal but still even when I was post graduate beaten, dragged and policemen were kicking and jumping like rats/mouse on my body thinking me loin in cage, in the police station for no fault of mine at the instance of persons supported by the criminals and rich and similarly earlier too in my teen age.

On the other hand, I have personal knowledge where criminals and killers never touched what to talk of beating, insulting etc them and secret agency men did agree met with me off the record for all this happenings in this country.

To conclude in brief, it can safe to say that all bad elements in form of politicians are product of Indian secret services including police in India.

It was all my family background and the environments luckily I got to reach to the present level and position. Mine is not an isolated case in this country thus I have no grievances for my past bad days in life in this my country though I might be feeling ashamed to say proudly that it is my country.

The secret agencies and police are meant for constructive jobs for safety and security of all citizens of the country and also whole of the country but these are being misused and remain ineffective as their sources of information are the criminals promoted by them. Ultimately, the agencies play into the hands of criminals like mafia of all types including bad characters using and selling all kinds of intoxicants at the instance and on behalf of police. It is a ground reality who can deny?

Do you think one of the most responsible and important pillar of democracy, media is not aware of it from every Village and street level onward as to how the agencies and police function in connivance with criminals in this country?

Similar is the case with judiciary and can not escape from shirking its responsibility for not exposing the flaws and vagueness of laws and the evils prevailing in society in the name of politics in India.

The judiciary and similar other constitutional criminal does and commits illegality and irregularities due to arbitrary discretionary powers, mistakenly or intentionally, provided by law itself as seen in practice.

The politicians by their act and conduct create fear psyche and embarrassment for their own people under the umbrella of forces. But in 21st century people started understanding that their inner sins do not allow them to move freely among the electorates which only reflects their insincerity and malafide intention towards public nothing else.

They are projecting a very dark and bad image of India within and outside.

For the reason of fashion and a status symbol, the security cover should not be provided at all. Normally, those provided more security men were/ are blood suckers of public and openly indulge in crimes as constitutional criminals and remained protected so.

The Delhi High court rightly observed, "If these people feel so threatened they should not come out in public places." The authorities and the law allow them security for the purpose, are equally responsible for the inconvenience of public, creating fear psyche for people and encouraging the constitutional crime by providing the unwarranted protection.

It is rightly said that under the circumstances they were not ‘national asset’ to protect though Hon’ble Delhi High Court restrained to use more harsh language, in fact, which they deserve.

Why we recommended that the Official Secrets Act must be abolished

Because the Official’s secret Acts and the rules are being misused mostly as a tool to hide sins of corrupt and inefficient. Thus these are required to be amended to greater extent for transparency and fixing the responsibility of policy makers and investigating agencies.

The Official Secrets Act must not be abolished to the extent to give prior information regarding the raids but thereafter outcome of such raids should be transparent and disclosed within the reasonable time after the investigation to dispel any rumours and the wrong impression that the raids conducted were not necessary and carried out due to vindictiveness.

In absence of it, the credibility of raiding and investigating agencies are always doubted on the grounds of ulterior motives and malicious reasons. It is also a great set back to the performance of investigating agencies deployed to act within the parameters of ‘Rule of Law’.

Inequality due to disproportionate purchase and thereafter the sale of same kind i.e. immovable and movable property at very higher rate is cause of alarming economic disparity in India.

The real owner and producer after sale of the property at a very low rate to colonizer and businessman e.g. multinational companies, is moving downward due to his maintained illiteracy and backwardness since ages leaving a few exceptions.

Officials’ secret acts

Officials' secret acts should not mean to cover up the corrupt and non-constructive deeds of government machinery in any form to give impression that citizens of India are less trustworthy than the corrupt machinery operating in India.

If it is so to consider always that citizens of India are less trustworthy then the message is worrisome having hidden dangerous implications for the fate of country without any remedy in sight.

Time for senior government figures to call for major reform of Intelligence agencies?

The destructive role of Indian agencies of their own countrymen must be exposed in a true welfare State claiming to be the biggest democracy of the World without it there is no real democracy here in India.

The days are far away when “People should be willing to approach a policeman with the same assurance with which they visit a doctor in this country”.

It is common to see that local criminals or gangs, goondaism, dadagiri and the persons involved in kidnapping, extortion, economic offences etc are supported by police, they being their sources of income and corruption, almost monthly is settled by the gangsters.

The indiscipline in police is due to criminality in Indian politics.

The apex court’s judgments must be obeyed in letter and spirit unquestionably but in practice it is not so because the judgments are doubted being not unbiased, uninfluenced and unaffected from the other considerations.

These remain and seen to be over-ruled anytime. Now in these days of awareness, it is becoming open secret and the talk of day that the very appointments of judges and court officials are political in nature.

The apex court miserably failed to take notice and check the State sponsored terrorism in India. The orders of restraining of ruling parties from going ahead with the State sponsored ‘state-wide bandhs’ in their respective States are doubted being only an eye wash exercise and a publicity stunt for outside propaganda.

Normally, during the ruling party sponsored bandh, the chances of violence are always negligible. Such ‘state-wide bandhs’ are held only to maintain the aspirations of their people and highlight the issues of their benefit as is the case presently of Tamil Nadu. The present stay order of the apex court is also not without suspicion and to be taken as stage-managed only.

THE STATE REPRESSION AND ROLE OF THIRD CENTRAL AGENCY TO FINISH SIKHS IN INDEPENDENT INDIA

What role the Sikhs played to finish Sikhs in Punjab and elsewhere and why? Whether there is an end to it or the Sikhs would continue to play their nasty role due to fear and greed? These questions related to the dignified safety and security of Sikhs in particular and non-Sikhs in general can not be solved without setting up a ‘Constitutional Commission’ for bringing the truth on surface for justice to all, about the past genocide of Sikhs and innocent killings of others through the ‘National policy and Strategy’, State terrorism by the Third Central Agency’ in independent India.

The genocide of Sikhs committed in India in the past in a planned and systematically manner is being projected wrongly as only a result of enmity of Sikhs among themselves to suppress the truth. For the entire Sikh genocide, only former DGP’S of Punjab, K.P.S. GILL and S. S. VIRK are being held responsible directly by the persons like Sardar Simranjit Singh Mann at the instance of inimical forces working and active continuously against Sikhs.

The main alleged projected “hero” of the State terrorism former DGP of Punjab, K.P.S. GILL demands the setting up of such a ‘Constitutional Commission’ for bringing the truth on surface for justice to all and rightly having reasonable apprehension that such a commission might not suit any government, however, the people of Punjab deserve to know what was the truth, who fanned the militancy and how terrorism was brought “under control”.

Here, ‘the Sikhs’ mean selected leadership in religious uniform likely to remain a model as a show piece to the satisfaction of the ‘Third Central Agency’ and Sikhs mean Sikh masses i.e. common Sikhs and third rate innocent leadership. The “Religious Babas” are another uncontrollable menace in the hands of the agency to the disadvantage of Sikhs.

The non-Sikhs, a few from Punjab for their own reasons and may be innocently are participating as intruders without understanding the game of the agency doing special task to finish Sikhs by all mean means everywhere at cost of the lives and loss of even Hindus. Non-Sikhs of Punjab otherwise are in the Sikh main stream i.e. having appreciable Punjabi spirit of peaceful living and maintaining the brotherhood without any hate.

When former DGP of Punjab, K.P.S. GILL writes, “The real question is whether a strategy of State Terrorism was adopted by the police; and the answer is unequivocally in the negative” is conveying something much more, meaning thereby that truth can come out only by setting up a ‘Constitutional Commission’. Is the policy of ‘divide and rule’ and finish the ‘spirit of brotherhood of people’ as an international policy of rulers at large a World phenomenon? For the reasons, whether the hate crimes are encouraged and supported always by way of the ‘National policy and Strategy’ i.e. State terrorism by the Third Central Agency’ as experienced in independent India or not?

The answer definitely should be ‘no’ for those who follow ‘Rule of Law’ unquestionably and fully believe in it and wish to be identified as respectable citizens of a welfare State in the World.

It seems that nobody remained unaffected internationally for the reasons of the inhuman policy prevailed, practiced and exercised in India. The police officials in uniform and others were intoxicated and glorified with promotions, awards etc. can be identified for facing justice.

The police officers involved are also under tremendous pressure to suppress the truth and to say the policy needed and for the reason, they only say it so defensively without noticing its inhuman face and adverse affect Worldwide but in the long run, they may not agree to act under the pressure for hiding and suppressing the truth.

The time may come when the inhuman ‘National policy and Strategy’ of Indian state terrorism would be known as a ‘Human Tragedy’ internationally. And the ‘Rule of Law’ is being obeyed in violation openly.

In the present scenario, who are responsible for the hate crimes? The Institutions of minorities are under attack through the mismanagement and by further adding the ruinous, destructive and foolish beliefs as evils in the name of false history, religion, spirituality etc to justify the wrong and foolish notions and beliefs of majority community.

It is a progressive step that the Senate passed the Local Law Enforcement Hate Crimes Prevention Act of 2007 (LLEHCPA). Otherwise, there is no-one to answer and where is the authority to provide justice to the victims in India and elsewhere? The questions and issues are being repeatedly asked and raised; those remained unanswered without any meaningful action and solution so far.

Pray to GOD for the dignified safety and security of ‘HUMANITY’ under the circumstances.

Former DGP K.P.S. GILL seems to rightly said that due to the reasons, a commission to study all aspects of terrorism in the state might not suit any government, however, the people of Punjab deserve to know what was the truth, who fanned the militancy and how terrorism was brought “under control”.

It was rightly presumed since long that all types of crimes in India are committed at the instance of Indian police and agencies to extort money for the politicians who have become or behaving themselves like thieves and criminals under the Indian inhuman National Policy and strategy.

The persons in opposition who differ with the inhuman policy are also targeted, weakened and eliminated by all means and a commission to study all these aspects might also not suit any government.

The Indian press is being advised to be responsible for not reporting all this happenings which to be considered against the government policy.

Is there anyone expected in India and elsewhere to suggest the remedy to safeguard the lives and property of innocent and hapless Indians in the present system?

“CATS” ON THE RUN-HOW IT CAN BE?

Is it not surprising that before the arrest of former DGP S.S Virk, the identification and whereabouts of all the “cats” were not known to the Punjab Police or Vigilance Bureau and they (“cats”) remain on the run to terrorize the people of Punjab till date? Every body asks questions that “cats” are on the run as how it can be?

Is it not an open secret that the “cats” of different categories are creation of Central agencies in connivance with senior Punjab police officials, presently occupying high positions in the present government of Badal Sahib then as to why the “cats” are on the run and remained to be unidentified? Really surprising and it is not appealing at all to any prudent mind under the circumstances!

The undue publicity and misuse of “cats” under inhuman policy and strategy by hiding their identity does also not enhance the reputation of present government on the question and ground of security and safety of people. All these dirty tactics must be done away at least now and details of ‘cats” be exposed for the knowledge of all without wasting anytime hereafter and guilty must face justice.

Keeping in view, the irresponsible conduct and act of Punjab government so far, it can be safely concluded that crime in India is the handiwork of respective governments through their contract killers known as “cats” in different categories and styles. BJP is openly supporting the cruel policy and strategy being a ‘Fundamentalist National Party’. Now question arises as from where to get justice?

It is what the inhuman policy and strategy of governance in independent India is going on under the cover and in face of message of welfare State outside? In face of this situation, has the international community any role to play for the sake of humanity and to upkeep the human values and norms?

“CATS” CATEGORIES OF DIFFERENT KINDS TO BE IDENTIFIED FOR WRITING THE UNBIASED PAST BLOODSHED HISTORY OF PUNJAB IN INDEPENDENT INDIA

In fact, that keeping “cats” is unapproved and illegal policy of the central agencies having political backing and it was to create terrorism not to tackle terrorism for political reasons in the past best known the Union government of India.

The inhuman policy and strategy worked for the past almost three decade to weaken Punjab as whole and especially Sikhs and in that order, Sikhs and others were eliminated by the forces, “cats” and “brigades” by different ways and methods, tortured, humiliated with the result a many more turned “cats” when ‘Jarnail Singh Bhindranwala’ refused to follow the inhuman policy and strategy of his masters and then murdered him in an Indian Army attack-1984 on ‘Holy Sikh Shrines’.

Thereafter, the persons like Sardar Simranjit Singh Mann and other third degree cats emerged to work for the central agencies separately and they kept divided strategically to condemn each other so that they should not become anytime a force to challenge the authority of Indian government to get justice and the demands of Sikhs fulfilled. The persons involved in the inhuman policy and strategy and its beneficiaries would always be remembered as ‘Traitors’ of Sikh Nation in history.

The traitors are not difficult to be identified by the present government if it is sincere to humanity to uphold the moral human values and norms in order to improve its face internationally? Moreover, it shall further help to write unbiased bloodshed history of Punjab in independent India. Sardar Parkash Singh Badal’s government should not miss the chance at any cost to do this human and noble task.

In a democratic country like India, it can not be described as part of a national policy and strategy to tackle terrorism. It was purely politically motivated unwritten policy of central agencies having strong political backing to finish Sikhs and weaken Punjab. Indian government, its agencies and National political parties has not amended her ways to have political gains at the cost of minorities in open connivance with different kinds of lawlessness and greedy “cats” and stooges from within the minorities working under the guidelines of their masters and agencies even today.

Though to isolate the Akalis from Sikhism, they were also targeted during the period of ‘burning Punjab’ but their silence since long about inhuman policy and strategy of centre would continue to remind Sikhs as an unforgettable and painful chapter of Sikh history.

Now it is suitable time for the government of Punjab to be honest to dig out and expose the entire inhuman policy and strategy followed by the greedy to create terrorism in Punjab and elsewhere to defame and weaken the people of Punjab for the selfish reasons.

The step in this direction in the given situation shall definitely prove a ‘landmark achievement’ on the part of present government of Punjab to expose the misdeeds and excesses committed against people on this part of Earth.

The Sikh Vichar Manch expects that Dr. Manmohan Singh’s government at centre working under the active supervision of Sonia ji would do everything possible to assist in the cause to improve the image of India and set an example for providing justice to those who suffered under the inhuman strategy which is no more secret now within and outside.
