SHAMEFUL ACT OF DOUBLE AGENTS
 

Bhai Balwant Singh’s Sister Bibi Kamaldeep Kaur and her husband Kaka Baljit Singh Sooch along with others petitioned before Sri Akal Takhat Sahib for Justice as the double agents, intentionally and deliberately, planted and highlighted false news to glorify themselves and for their own fame by victimizing, defaming and humiliating Bhai Balwant Singh’s Sister in the eye of society

Chandigarh, Punjab - Kamaldeep Kaur sister of Balwant Singh, who is currently lodged in Burail Jail, Chandigarh for his role in assassination of former Punjab Chief Minister Beant Singh, has complained to the Takht Jathedars about two Chandigarh based two human rights lawyers Amar Singh Chahal and Arvind Thakur.   She has also complained about Daljit Singh Bittu's unnecessary interference in this case.

Kamaldeep Kaur along with her husband Baljit Singh and several other individuals met Akal Takht Jathedar Joginder Singh Vedanti during the recent meeting of Sikh clergy and handed over a written complaint, in which she accused both the lawyers of hurting her sentiments.

As per Kamaldeep Kaur, the Sikh clergy has assured them to look into the case. She said that the Sikh clergy told them Arvind Thakur is non-Sikh so he did not fall under Sikh marayada but Amar Singh Chahal is Sikh so clarification would be obtained from him. 

Shiromani Akali Dal (Amritsar) had already sent a formal complaint to the Chairperson  of the Bar Council of Punjab and Haryana against both the lawyers accusing them of humiliating and embarrassing Kamaldeep Kaur.  This complaint was sent by Prof. Jagmohan Singh, the General Secretary of SAD (Amritsar) and he requested the Chairperson to entertain and try this complaint as it is within his jurisdiction and entrust it to the concerned Disciplinary Committee.

As per Prof Jagmohan Singh, who is also Spokesperson of SAD(A), he had filed the complaint as his sentiments have been deeply hurt and gross injustice done to the concerned parties, by the grossly malicious and fictitious utterances of the two lawyers in the cases of Sikh youth undergoing trial in the Special Court inside the precincts of the Model Burail Jail, Chandigarh.

He said this had marred his reputation as a responsible activist.  Prof Singh mentioned in the letter, "The role and media bash of the lawyers is unprofessional conduct and in total violation of the code of conduct of lawyers as laid down by the Advocates Act, 1961.  As I have demonstrated here, Arvind Thakur rushes to the media more frequently than the police.  These lawyers had not acted within the legally permissible norms." 

As the General Secretary and Spokesperson of the Shiromani Akali Dal (A), it is my duty and responsibility to act upon news items of gross injustices to Sikhs, from time to time.  On 9th August, 2006, there appeared a news item in most newspapers of Punjab, that Kamaldeep Kaur was severely humiliated and insulted by the jail staff when she went to the Burail prison to tie Rakhi to her brother Balwant Singh.  Reading the news story, I was livid with anger.  On that day, that is 9th August, 2006, I had scheduled a press conference of my party in Ludhiana for a different reason. As this case was also very painful and disgusting, and knowing fully well that nowadays sensational journalism is increasing, I attempted to verify the details from the lawyers concerned.  I was unable to obtain the phone number of  Arvind Thakur, who works with  Amar Singh Chahal, under his active guidance and support.  So I called up  Amar Singh Chahal to verify the veracity of the incident as reported in the media.  I told the learned lawyer that I will be condemning the incident in no uncertain terms and would like to know the truth. He confirmed the incident and acting in good faith, I strongly condemned the incident in the course of my press meet.

Fortunately for me and for the young lady in question, my media comments were reported in an innocuous manner in one newspaper. I have since learnt from the lady herself and from all other sources in Chandigarh that no such incident, as reported, took place at all.  The lawyer, Arvind Thakur had blown this up in the media, without realising the damage that he was doing to the reputation and personality of the said lady. Before I could retract my comments, the lady herself clarified the position and accused the lawyers of overstating facts for their petty publicity gains. This non-professional role of the lawyers has deeply upset me.

I would like to say here, that Arvind Thakur had done a similar thing earlier too.  On July 13, 2005, he had intentionally and deliberately alleged to the press that the Delhi police had thrusted cigarettes and other intoxicants into the mouth of Jagtar Singh Hawara and that he was forced to spit on the photographs of Sikhs Gurus.

While the first part of the allegation was to some extent correct, the second one was simply a figment of imagination of Arvind Thakur.  I and all others who reacted to these two incidents were deeply pained to know that the impugned incidents were totally false and concocted.

We would like to know as to under what circumstances have these lawyers given these statements and who has been prompting them to do so? Are they double crossing their clients or are they seeking cheap publicity to bolster their public images?  While we appreciate the role of the lawyers who take up difficult cases against the state, no civil society can condone malicious behavior and scurrilous comments against any individual and more so against a young lady.   The lawyers have so far not retracted their blatant lies."

Prof Jagmohan Singh had sought a high-level inquiry by an impartial disciplinary committee and action against the two lawyers for their unprofessional misconduct and unwarranted actions in the media under appropriate provisions of law.

October 6,  In the past few days, the statement issued by Bhai Daljeet Singh Bittu, which mentioned that organizations and individuals taking part in the Sikh Struggle should desist from mudslinging against one another in the press. We would like to give a clarification that we never made any such statements to the press. The two lawyers Amar Singh Chahal and Arvind Thakur, gave erroneous statements to the press for some personal gains. Without putting the blame on any person, we clarified what was reported in the media. Even then, the two lawyers did not stop from giving untrue statements to the press. We would like to ask Bhai Daljeet Singh Bittu, what is the contribution of Amar Singh Chahal and Arvind Thakur to the Sikh Struggle? When countless Sikh youth were being murdered on a daily basis, where were these lawyers, Amar Singh Chahal and Arvind Thakur?

Even if these lawyers did contribute to the Sikh Struggle, that still does not give them the right to give such false, made-up reports to the media and make degrading remarks against Balwant Singh (Beant murder case). Balwant Singh only replied to the mudslinging of these lawyers by saying, 

 “If these allegations against me are proven true then I will accept any punishment and if these allegations are proven false then the faces of these lawyers should be blackened." 

Bhai Daljeet Singh Bittu said that this issue should be settled with dialogue. However, what has he done regarding his given solution? Even today, we are prepared to meet at any Gurdwara Sahib in Ludhiana. Panthic leaders may participate in the meeting where all our questions should be answered. We will also clarify anything from our side. If Bhai Daljeet Singh Bittu cannot arrange this, then he should cease from making such misleading statements.

Would he have still honored the two lawyers if they had given erroneous statements regarding him and his family members?    

If Bhai Daljeet Singh Bittu is taking this issue seriously then he should give up his double standards and take a clear stand. To resolve this issue the approach should not be limited to giving statements through the media.

Bhai Daljeet Singh Bittu should clarify to us that if these lawyers, Arvind Thakur and Amar Singh Chahal, agree that they are working with the Panth, then what kind of image of themselves are they presenting by making erroneous statements and false allegations against Balwant Singh?
